Terms of Service
The terms that govern your use of HerdDirect and our marketplace.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of herddirect.net and the HerdDirect marketplace operated by HerdDirect LLC ("we", "us", "our"). By accessing or using HerdDirect, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Our Service
HerdDirect is a marketplace that connects customers with partner farms selling beef and related products. We facilitate listings, orders, payments, and delivery coordination, but the farms — not HerdDirect — raise, prepare, and ship the beef. We are not a party to the sale between you and a farm, except as the platform that processes the payment.
3. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use HerdDirect. By placing an order, you represent that you meet these requirements and that the information you provide is accurate.
4. Your Account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You agree to provide accurate, current information and to update it as needed. You may not share your account or use another person's account without permission.
5. Orders and Payment
When you place an order, you authorize us to charge the payment method you provide through Stripe. Prices are listed in U.S. dollars and may change at any time. We reserve the right to refuse or cancel an order. If an order is canceled before it is fulfilled, we will issue a refund through the original payment method.
6. Delivery
Delivery timelines depend on the partner farm and may vary. Estimated delivery dates are not guarantees. You are responsible for providing a correct delivery address and for receiving perishable goods promptly. We are not liable for spoilage or delays caused by incorrect address information or failure to accept delivery.
7. Returns and Refunds
Because beef is a perishable product, all sales are final unless the product arrives damaged or does not match your order. If there is a problem with your order, contact us at theherd@herddirect.net within 48 hours of delivery and we will work with the partner farm to make it right.
8. Farm Partners
Farms that list products on HerdDirect are responsible for the accuracy of their listings, the quality of their products, and fulfilling orders. Disputes about a specific farm's products should first be raised with that farm, and we will help facilitate a resolution where possible.
9. Acceptable Use
You agree not to use HerdDirect to place fraudulent orders, interfere with the service, scrape or copy content, transmit viruses or harmful code, infringe others' rights, or use the service for any unlawful purpose. We may suspend or terminate access for violations of these Terms.
10. Intellectual Property
All content on HerdDirect, including text, graphics, logos, and software, is owned by HerdDirect LLC or its licensors and is protected by intellectual property laws. You may not copy, redistribute, or create derivative works without our permission. Farm listing content remains the property of the respective farm.
11. Disclaimer of Warranties
HerdDirect is provided "as is" and "as available." We make no warranties, express or implied, about the service or the products sold through it. Product descriptions, availability, and delivery estimates are not guaranteed. Beef products are sourced from independent farms, and product quality may vary.
12. Limitation of Liability
To the fullest extent permitted by law, HerdDirect LLC and its partners shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising out of your use of the service. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.
13. Privacy
Your use of HerdDirect is also governed by our Privacy Policy, which explains how we collect, use, and share your information. These Terms and the Privacy Policy together set out the full agreement between you and HerdDirect.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the bottom of this page and, for material changes, provide notice through the website. Your continued use of HerdDirect after changes take effect means you accept the updated Terms.
